How does ABA Rule 1.8 actually constrain what we can send?
Rule 1.8 restricts lawyers from soliciting substantial gifts from clients, and from preparing an instrument giving them one (unrelated to what you do). It doesn't cap what a lawyer can give a client at holidays — that's not a 1.8 violation. What you want to avoid is a gift so valuable it looks like an inducement. $300 noise-canceling headphones to a bankruptcy client? Questionable. A $175 curated box at year-end? Standard. We'll send you a plain-English one-pager.
Can we send a gift to a client's spouse or family member?
Yes, and this is actually a common tiered move — a separate, smaller gift to the spouse signals you see the relationship, not just the billing matter. We offer a $95 Signature tier specifically for the spouse / family-member extension. Same delivery window, same handwritten card protocol.
When's the actual cutoff for a Q4 holiday program?
November 1 is the practical deadline for a 60–100 gift program. That gives us three weeks for curation lock-in, card proofing, address cleanup, and a pre-Thanksgiving delivery wave. Miss November 1, we can still run it — but SKUs narrow and OC same-day tier priority gets reallocated.
Are these deductible for the firm?
The IRS $25 per-recipient cap under §274 applies to the gift item itself. Packaging, shipping, handwritten card work, and marketing-intended branding sit outside that cap (Pub 463, §162). Most firms expense client gifts under client-development / marketing, and we break the line items on your invoice so your controller can apply the right treatment. Your firm's CPA or tax partner has the last word.
Can our firm administrator order directly without going through a partner every time?
Yes. Managed Program clients get admin-level access: pre-approved SKUs, PO number on file, NET-30 invoicing, and a self-serve upload. Your admin runs the program; partners sign off once per year on the tier assignments and budget.
